Swimmers Ed Ltd – Terms and Conditions
Swimming Lessons at Burstow Park Swimming Pool
These Terms and Conditions apply to all swimming lessons, courses, and activities provided by Swimmers Ed Ltd(“we”, “us”, “our”). By enrolling in our swimming classes, you agree to be bound by these Terms and Conditions.
1. Bookings and Enrolment
1.1 All swimming lessons must be booked in advance via our approved booking system – Class For Kids.
1.2 A place in a class is only confirmed once full payment has been received or a subscription is set up.
1.3 Enrolment is subject to availability and appropriate ability level as determined by Swimmers Ed Ltd.
1.4 We reserve the right to move swimmers to a more suitable class if required for safety or progression.
2. Fees and Payment
2.1 All lesson fees must be paid in advance or subscription in place.
2.2 Fees are payable per term, course, or monthly via subscription unless otherwise stated.
2.3 Fees are non-transferable and may not be used for alternative services unless agreed in writing.
2.4 Swimmers Ed Ltd reserves the right to review and amend fees with reasonable notice.
3. Cancellations, Refunds and Missed Lessons
3.1 No refunds or credits are given for missed lessons due to illness, holidays, or other personal circumstances.
3.2 If Swimmers Ed Ltd cancels a lesson due to circumstances within our control, a replacement lesson or credit will be offered where possible.
3.3 Lessons cancelled due to circumstances beyond our control (including pool closure, extreme weather, loss of water supply, power cuts or emergency situations) may not be refundable, but we will endeavour to offer a suitable alternative where practicable.
3.4 Notice of withdrawal from a course must be given in writing via email. Refunds are not guaranteed once a course has commenced.
4. Arrival, Supervision and Conduct
4.1 Parents/guardians are responsible for the supervision of children before and after lessons.
4.2 Swimmers Ed Ltd instructors are only responsible for swimmers during the scheduled lesson time.
4.3 Swimmers must arrive promptly and be collected immediately after their lesson.
4.4 Disruptive or unsafe behaviour may result in removal from the lesson without refund.
4.5 All animals on site must be ignored.
4.6 Nobody should enter the pool building outside of their booked swimming class timeslot.
5. Health, Medical Conditions and Fitness to Swim
5.1 It is the responsibility of the parent/guardian or adult swimmer to inform Swimmers Ed Ltd of any medical conditions, allergies, or additional needs prior to lessons commencing.
5.2 Swimmers must not attend lessons if they are unwell, particularly with contagious illnesses.
5.3 If Vomiting or diarrhoea has occurred then swimmers are not able to enter the pool until 48 hours after the final episode.
5.4 Swimmers Ed Ltd reserves the right to refuse participation if a swimmer is deemed unfit to take part safely.
6. Safeguarding and Welfare
6.1 Swimmers Ed Ltd is committed to safeguarding and promoting the welfare of children and vulnerable adults.
6.2 All instructors are appropriately qualified and DBS checked in accordance with UK safeguarding requirements.
6.3 Our safeguarding policies are available upon request.
7. Pool Rules and Facilities
7.1 All swimmers and spectators must comply with Burstow Park Swimming Pool rules at all times.
7.2 Swimmers Ed Ltd is not responsible for the main structure of the building or the plant room. Swimmers Ed Ltd are responsible for the cleanliness and facilities of the pool venue.
7.3 Any damage caused by swimmers or spectators may result in liability for repair or replacement.
8. Photography and Video Recording
8.1 Photography or video recording is not permitted during lessons without prior written consent.
8.2 Swimmers Ed Ltd may use photographs or videos for promotional purposes only with explicit consent.
9. Liability
9.1 Swimming carries an inherent risk. Participation is at the swimmer’s own risk.
9.2 Swimmers Ed Ltd accepts no responsibility for loss or damage to personal property brought onto the premises.
9.3 Nothing in these Terms limits liability for death or personal injury caused by negligence where liability cannot be excluded under UK law.
10. Data Protection
10.1 Swimmers Ed Ltd processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR).
10.2 Personal information will only be used for the administration of swimming lessons and will not be shared with third parties without consent unless required by law.
11. Changes to Lessons or Terms
11.1 Swimmers Ed Ltd reserves the right to change lesson times, instructors, or class structure where necessary.
11.2 These Terms and Conditions may be updated from time to time. The most recent version will always apply.
12. Governing Law
12.1 These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.
12.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
